COSMETICS BY SHAYNI - TERMS AND CONDITIONS FOR MODELS

You should understand that by booking any of our courses, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference. Please understand that if you refuse to accept these terms and conditions, you will not be able to book any courses from the site.

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

Your booking constitutes a request to us to reserve an appointment for you on our booking system with a specific date and time. All bookings are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email confirming that an appointment has been reserved for you on the booking system. The contract between us will only be formed when we send you the booking confirmation.

The contract will relate only to those appointments for which we have provided a booking confirmation and the full amount stated on the booking system has been paid prior to booking.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.


You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

REFUNDS POLICY

Please note if you are cancelling your appointment or training course 72 hours before your booking, your 50% deposit will not be refunded and course deposit will also not be refunded due to the nature of this service.

TERMS OF SERVICE

This website is operated by Cosmetics By Shayni. Throughout the site, the terms “we”, “us” and “our” refer to Cosmetics By Shayni, offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.


Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

PAYMENTS

Prior to your appointment booking full payment is required in full for the treatment, this will reserve you an appointment on your chosen date and time. This is to ensure we secure model appointments for our paying students that will be attending the course and require models for the certification of this.

PHOTOGRAPHY

By agreeing to the terms and conditions in this document you are also agreeing to photograph/video usage which may be taken during your treatment. The content may be used across all social media platforms and you will also have full access to all footage taken throughout your treatment should you request it.

REFUNDS

All model appointment fees are non-refundable and non-transferable. Once your appointment has been booked and balance has been paid, you will be allocated a date and time during our training course for our students to provide treatments for their case studies. Therefore, we remain liable to provide models for our students to ensure their training has been accessed and completed. Non-refundable payments are implemented to ensure the guarantee the models required to complete case studies and training. 

Cosmetics By Shayni is unable to offer refunds for cancellations out of our control i.e adverse weather conditions, terrorist attacks, flooding, industrial action. An alternative training date will be offered.

All bookings are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email confirming that a place has been reserved for you on the course. The contract between us will only be formed when we send you the course confirmation.

 

The contract will relate only to those courses for which we have provided a course confirmation and the deposit stated on the website has been paid.

CANCELLATIONS

Faces Aesthetics & Training Academy must be notified of any cancellation for any reason 48 hours prior to the appointment time and date. This is to ensure that the appointment scheduled for our student can be recovered in time for the training date. All appointment deposits are non refundable.

RESCHEDULING REQUESTS & FEES

In the event of a genuine reason for cancellation (proof of which may be required); of a confirmed appointment date notified prior to the confirmed appointment date and time, a request for a transfer will be considered at the discretion of Cosmetics By Shayni (subject to availability). If successful, an administration fee of £25.00 per appointment will be charged. Non-attendance where no prior notice is given will be handled at the discretion of Cosmetics By Shayni and may result in loss of full appointment fees.

Should you be unable to attend a confirmed appointment for medical reasons, a valid medical certificate covering your name and day of the appointment will be required to waive the fee to reschedule. Under medical or compassionate circumstances (proof of which may be required) and where immediate rescheduling might not be possible; the payment of the appointment may be placed on file as a gesture of goodwill. Appointments will be valid towards student model appointments only and run for a period of up to 6 months from the date of issue at which time the appointment fees would be forfeited. No refund of appointment fees can be issued.

NAMED CLIENT/MODEL

Model appointments are transferable to an alternative model. Please ensure the transferable appointment is made giving the correct name of the person attending the appointment at the time of making payment. Amendments to this will be free of charge unless booked for Anti-Wrinkle or Dissolve appointments, a £30 fee will be chargeable to cover prescription cost fees for these transferable appointments must be notified 7 days before the booked appointment date and time to ensure replacement prescriptions have been prescribed. Treatments will not be carried out and loss of appointment fees will occur should we not receive notice within the 7 day period.

In the event that Cosmetics By Shayni should have to cancel the training course your appointment is confirmed for, for reasons outside of our control; We will endeavour to give models at least 24 hours’ notice of any cancellation by telephone and/or email. The Academy is not responsible for any accommodation/travelling costs models may incur.

APPOINTMENT TIMES

Please do not arrive any earlier than 10 minutes prior to your appointment time as the student may be with another client. If you arrive 15 minutes later than your confirmed appointment time, you will be refused entry to the appointment. This is to avoid disruption for students on the course.

Please therefore ensure you allow sufficient time for travelling to your appointment. Make use of Google maps on smart phone or print map/directions from our website when planning your journey beforehand, to assist you to locate the clinic on the appointment day. 

CONFIRMATION OF BOOKINGS

Bookings for appointments are made by contacting our bookings team by either telephone or email. Once a confirmed time and date has been given you will receive an email of our payment details for full payment for the appointment, only once full payment has been made will your appointment be confirmed via our booking system. Model appointment bookings are not taken directly on our booking system and are inputted manually by our admin team. 

In the first instance, please contact our team at cosmeticsbyshayni@gmail.com regarding your reschedule request (or non-attendance), who will respond within 24 working hours.

You should understand that by booking any of our courses, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference. Please understand that if you refuse to accept these terms and conditions, you will not be able to book any courses from the site.

PAYMENTS

Our site will take a deposit for your course booking, this will reserve you a place on a course. The remaining balance of a course is required in full on the first date of your course. 

 

The only exception is if you have used our finance option with Payl8r in which the full balance would of been paid directly to us through Payl8r (please ensure you have read Payl8r terms and conditions as the companies documents are separate to ours). 

PHOTOGRAPHY

By agreeing to the terms and conditions in this document you are also agreeing to photograph/video usage which may be taken during your course. The content may be used across all social media platforms and you will also have full access to all footage taken throughout your training with us which will be sent over to you for you to also use for advertisement across your own social media platforms. 

REFUNDS

All course deposits are non-refundable and non transferable. Once your course date has been booked and deposit has been paid, our site will send all relevant training material. Therefore as we incur a materials fee for all courses we remain liable to cover regardless of whether the course is accessed and/or completed. Non-refundable deposits are implemented to cover fees for materials should you need to cancel your course date.

 

Cosmetics By Shayni is unable to offer refunds for cancellations out of our control i.e adverse weather conditions, terrorist attacks, flooding, industrial action. An alternative training date will be offered.

 

Once your deposit has been paid you will be sent you your pre course study workbooks so you can begin your course and prepare for your training day. If for any reason you cannot make your selected training date, you can request to reschedule to a different date. You must give us 3 working days notice in writing if you would like to reschedule your training date. You can only reschedule once. If you need to reschedule a second or a further more time(s) you will need to pay your deposit again. Your deposit can not be transferred to a different course. 

NAMED STUDENT

Booked training is non-transferable to an alternative student. Please ensure the booking is made giving the correct name of the person attending the course at the time of making payment. Amendments to this will be chargeable at £25 per course date/person, where possible for a change to be accommodated and a minimum of 48 hours’ notice prior to the course date is required, in writing. In the event that Cosmetics By Shayni should have to cancel your course for reasons outside of our control; We will endeavour to give students at least 24 hours’ notice of any cancellation by telephone and/or email. The Academy is not responsible for any accommodation/travelling costs students may incur due to the cancellation of courses.

ONLINE COURSES

All online courses are strictly non-refundable as we incur material fee for for all online courses which we remain liable to cover regardless of whether the course is accessed and/or completed. Please ensure online courses meet your training needs, you have a suitable device connected to the internet through which to access the course/portal and are able to source the products/tools/models you require to complete the necessary case studies to pass the course. We may consider transferring students to one of our other online courses to the same value as goodwill, where a course is found to be unsuitable for an individual student; although this may be subject to an additional registration fee.

 

What if I do not feel confident during my training course? 

 

No certificates will be provided until both your trainer and yourself feel confident that you are able to proceed with offering the course that you are training in. We endeavour to ensure you are confident before the end of the training course and we are happy to extend the duration of the course until we believe you are ready to work solely without guidance. 

GENERAL

All practical training must be completed within 6 months of booking your course, unless otherwise agreed in writing at the time of booking. Should you fail to attend your original training dates for any reason and the course later be retired or amended in content, no refund or difference in courses fees will be offered. You may however, look to use the course fees on file as a credit towards payment for an alternative course of your choosing within 6 months of the original date of booking. Students who fail to book, attend or reschedule training within 6 months of enrolling upon their course (taken from date of making first payment) will forfeit any course fees paid. We cannot offer any refunds, credits or substitute training in such circumstances.

SERVICE TERMS & CONDITIONS

CONTRAINDICATIONS

By signing this form, you confirm that you are in a good physical condition and fully able to participate in the course and have not been advised to not participate by a qualified medical professional and that you certify that there are no health-related reasons or problems which preclude your participation at the training course. 

CAN I LEARN ALL I NEED TO IN A SHORT SPACE OF TIME?

The manual you receive from your tutor covers all theoretical information covered on the day of training as well as extra information for you to read in your own time. We cover theory on your training day(s) and we will check for understanding all throughout the duration of your course. 

If for any reason you refuse to sign these terms and conditions on the day of your training, you will not be allowed to attend and train with us and you will waive the right to a refund of your course for all monies paid including the booking fee. 

MINIMUM COURSE AGE

We accept all students aged 18 years or over for our face to face training courses. With regret due to insurance reasons, we are unable to accept students aged under 18 years on the day of training for face to face courses, however online courses are open to those of any age as no attendance of our centres is required. Please note most insurers will only provide public liability (beauty therapist) insurance for working with the general public to those aged 18 or over, although some selected companies will accept those aged 16 or over.

EQUALITY

Cosmetics By Shayni will not tolerate racial, homophobic or discriminatory abuse in any form. Anyone who is found abusing another student or member of staff will be immediately escorted off the premises and no refund will be given. The use of threatening behaviour and/or foul or abusive language is strictly forbidden. You agree that you will not discriminate against any material or content or any individual person. 

 

You will not slander, libel or defame Cosmetics By Shayni or any person or individual associated with Cosmetics By Shayni whether directly or indirectly nor contribute to or distribute such defamation whether oral and published. If you have any concerns, these can be risen with your tutor and will be handled responsibly, professionally and in a positive manner. 

If a learner has a disability or a learning difficulty please inform Cosmetics By Shayni to ensure the correct guidance and support can be offered

• If for any reason I cannot attend my course(s) I will let Cosmetics By Shayni know as soon as possible
• I understand that I am not entitled to a refund for any payments made for courses
• I understand that upon completion of the course(s) that I am going to be learning, Cosmetics By Shayni holds no liability towards my actions outside of supervised training

HEALTH & SAFETY

We offer a safe and professional standard of training, and ask all of our students to help maintain these standards and be reminded that our regulations are also compulsory for health and safety purposes. 

Students must arrive clean and well presented wearing black plain clothes or a tunic/scrubs. Hair should be clean and tied back off the face and nails need to be a workable length. High heels should not be worn, closed flat shoes should be worn.


The Health and Safety Work Act 1974 and subsequent legislation places a duty upon the management of an establishment to secure and maintain a safe working environment for all employees, contractors and those affected by the services provided. Cosmetics by Shayni provides information and procedures for accidents, fire and emergencies. 

Mobile phones must be switched to silent during lessons, however it’s heavily encouraged to film/take photos all throughout your training course of theory/practical work. 


Coats must be placed on the coat hangers provided, personal bags must be stored under the table or beauty couch you will be working at ensuring all handles are tucked away. 

How can you offer courses in such a short space of time? 

Often our academy will offer these courses with anatomy and physiology or even ask students to undertake case histories; however this is not a requirement or a legal prerequisite. You are able to take private courses and obtain a recognised certificate and get insurance as a practitioner (which allows you to use these therapies with the general public and charge for it). We do however include all the essential A & P you will be required to know in your course manuals for you to read in your own time.

PRIVACY POLICY

It is very important that your information is kept private and for this reason Cosmetics By Shayni will not sell, trade or rent your personal information to others unless you have given us your permission. The information is gathered when you book a course with us or fill in one of our online forms. We keep personal information of our customers private under the data protection act.

Accessing your home study course materials is part of your training and any course work should be completed before you attend your training day. 

 

Please ensure you allow sufficient time for travelling and returning from lunch. All students must attend the full training day until the end time. Should you choose or need to leave a course before the approximate end time, you will forfeit any course fees and may not achieve your certification.
